City of Palm Bay Parks and Recreation Player Contract and Accident Release/Financial Responsibility Clause
League Sport: SENIOR SOFTBALL: 2024 Season
I, below named Player hereby agrees to play the above designated sport during the 2024 Season for my designated Team or Teams in the City of Palm Bay’s Recreation Program designated above, in accordance with the Rules and Regulations of the City of Palm Bay and all the designated Sport Sanctioning Organizations to which the City of Palm Bay are members, unless released or waived in accordance with those Rules & Regulations. I certify that I am not to receive any compensation, direct or indirect, for playing the above designated sport with any City of Palm Bay Team. In consideration of acceptance of this Player Contract and permission to play the above designated sport during this current year, I hereby, for myself, my heirs, executors, and administrators, waive and release any and all rights & claims for damages I may have against the City of Palm Bay, my Team, all City of Palm Bay Playing Field Hosts, and all their members and member associations for any and all injuries suffered by me in games and practices for the stated City of Palm Bay Team with which this Player Contract is signed by me and/or Parent/Guardian. I am aware I must have my own Insurance Coverage (Liability & Personal Injury) to be eligible to participate & play in any manner in this Sports League. I assume all risks and hazards incidental to the conduct of the activity of the above designated sport, and do hereby waive, release, absolve, indemnify, and agree to hold harmless the City of Palm Bay, Brevard Senior Softball Association (aka B.S.S.A), all City of Palm Bay sanctioning organizations, members & member associations, and any host field agency for any injury to me as a registrant of the City of Palm Bay Sports Leagues. I am also aware that the City of Palm Bay and B.S.S.A do not provide insurance for any claim against the above stated groups. I grant permission to any and all City of Palm Bay representatives, host field agencies & my Team members to authorize and obtain medical care from any licensed Emergency Team, Physician, or Hospital/Medical Clinic should I become ill or injured while participating in the City of Palm Bay’s Sports Leagues. I agree to pay for any and all damages done by me, the registrant, with the exception of normal use to buildings, equipment, supplies, and/or other property under the authority of the City of Palm Bay host field agency. I understand and will abide by the Rules & Regulations prescribed by the City of Palm Bay’s Sports Leagues, any host field agencies, and sanctioning organizations governing the Sports Leagues and its Facilities. I agree to abide by any and all disciplinary actions upon any infraction of these Rules & Regulations. I understand and agree to all of the stated items above which permit me to be eligible and play in this Senior Softball Program
Assumption of Risk and Waiver of Liability Relating to
Coronavirus/COVID-19 for 2024 Season
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend physical distancing and have, in many locations, prohibited the congregation of groups and people.
The City of Palm Bay (City) has put in place preventative measures to reduce the spread of COVID-19; however, the City cannot guarantee that you or any other person will not become infected with COVID-19. Further, attending City sponsored activities could increase your risk and the risks of others of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending City activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at City activities may result from the actions, omissions, or negligence of myself and others, including but not limited to City employees, volunteers, and program participants, their families, and Brevard Senior Softball Association (BSSA)
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself, including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense or any kind, that I may experience or incur in connection with my attendance at City activities or programming. I hereby release, covenant not to sue, discharge, and hold harmless and indemnify the City, its employees, agents, representatives, and BSSA of and from any and all claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of the City, its employees, agents, representatives, and BSSA whether a COVID-19 infection occurs before, during, or after participation in any City program.
